The Basics of Capacity Assessment

In the world of Elder Law  much is discussed about legal capacity and competence and how it impacts the services we provide. Frequently families have concerns about the decisional capacity of their elderly loved one and ask about this during their consultation.   The answer however is not a simple “yes” or “no” when the question involves competency and capacity. While an adult is assumed competent until adjudicated otherwise, capacity is more relative. The question is really, “Capacity to do what?”
